WARRANTY COVERAGE

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Link Engine Management Ltd warrants that its Products are free from manufacturing defects in materials and workmanship under normal use and installation for the life of the Product, but subject to the limitations outlined below. This warranty applies only to the original purchaser of the Product and is non-transferable subject to any non-excludable laws including ACL.

The life of the Product means the period the Product continues to be used by the original purchaser. 

If a manufacturing defect arises and a valid claim is received, Link Engine Management Ltd will, at its sole discretion (but subject to any statutory rights you may have):

• repair the defective Product (Note: repair of the Product may result in the loss of user generated data), or
• replace it with a new or refurbished Product of comparable function,
• refund the purchase price of the product.

Products presented for repair may be replaced by refurbished Products of the same type rather than being repaired. Refurbished parts may be used to repair the Products.

HOW TO MAKE A CLAIM

To make a claim under this warranty, if you purchased the Product from us online you can contact us at the email address above setting out the circumstances and any supporting evidence that gave rise to your claim.  If you purchased the Product from one of our resellers you can take the Product back to them along with proof of purchase.  Any expenses you incur in making a claim shall be borne by you.

WARRANTY EXCLUSIONS

This warranty does not cover:

• Products that have been damaged or impaired due to incorrect installation, misuse, neglect, accident, or external causes such as water damage,
• Normal wear and tear or cosmetic damage,
• Products that have been modified or used with incompatible software or components,
• Products that are used in highway-registered vehicles (Products are intended for off-road use only) or used outside their intended purpose.

CONSUMER RIGHTS

This warranty is an extended warranty and is in addition to your statutory rights.  Nothing in this warranty limits or excludes any rights you may have under such laws.

SOFTWARE LICENCE

The Product includes a user-configurable software programme, which must be installed using the latest version available from the Link Engine Management website.

The warranty is voided if:

• The incorrect or outdated software version is used, or
• The user attempts modifications or setups that aren’t supported.

The software included in the Product is licensed, not sold. It may only be used in accordance with Link’s license terms. Link Engine Management Ltd grants the user a non-exclusive license to use the software:

• Only in the country where it was originally acquired,
• On a single device at a time,
• In accordance with the applicable End User Licence Agreement (EULA).

If the license is terminated by you or by Link (e.g. for breach of terms), the software must be permanently deleted.

The requirements set out in this section are only in relation to this warranty and do not limit or affect your rights under the ACL.
